1. Please print this language on the plans: "This project is located within the FEMA-designated coastal high hazard area. Any additions or changes to these plans must be evaluated by the Resource Planner to determine if the project constitutes a substantial improvement."
2. Please provide a completed modification worksheet. The worksheet can be downloaded here: http://www.sccoplanning.com/PlanningHome/ZoningDevelopment/Non-ConformingRegulations/ModificationEvaluation/Overview.aspx. Modification of 65% or more of the structure over a five-year period would meet the definition of development in the Geologic Hazards Ordinance (Section 16.10.040(s)), which means that the project would be subject to geologic review.
3. Please submit completed Substantial Improvement Forms, including a contractor affidavit, owner affidavit, and cost breakdown, based on the final plans. The forms can be downloaded here: http://www.sccoplanning.com/LinkClick.aspx?fileticket=FzxV4JVLAw0%3d&tabid=1001. Alternatively you may submit a contractor’s estimate for all of the proposed work, along with both of the affidavits provided at the link above. Please note that any current or future changes to the plans will be required to be included. Please note that the forms must reference the final revised plans once all agency comments have been addressed.
Once the Substantial Improvement Forms have been submitted, the project will be evaluated to determine if it meets the definition of substantial improvement, as defined in County Code Section 16.10.040(65). If the project cost estimate exceeds 50% of the structure’s assessed value ($210,892), an appraisal of the actual cash value of the structure, prepared by a licensed appraiser, and based on the cost approach, will be required.
If the value of the proposed improvements equals or exceeds 50% of the appraised value of the structure, the applicant shall modify the application to bring the structure into compliance with all FEMA and County regulations for new construction within the FEMA-designated VE Zone.
