PURPOSE:

 

To establish procedures for the development and annual review of departmen-

tal liability management programs.

 

 

LEGAL BASIS:

 

Board of Supervisors directive - February 23, 1993.

 

 

POLICY:

 

It is the policy of the County of Santa Cruz to annually review each de-

partments liability management program.  Each department will prepare and/

or update a liability management program report which will be submitted to

the Board of Supervisors.

 

 

PROCEDURE:

 

1.  Each department will on an annual basis report to the Board of Super-

    visors regarding its liability management efforts.  The report shall

    include, but not be limited to the following topics:

 

    A.  Safety meetings - a discussion of subjects discussed, issues re-

        solved, issues being worked on.

 

    B.  Equipment training - a discussion of types of training provided to

        employees and potential benefits.

 

    C.  Vehicle accident review - establish a department accident review

        committee to review all vehicle accidents.  Allow the driver(s)

        involved to appear before the committee to supply any additional

        facts that may pertain to the accident.  After all facts are re-

        viewed, the committee will determine if the accident was prevent-

        ible or not preventible and presents its determination to the de-

        partment head for additional training or corrective action.  The

        committee does not make recommendations for disciplinary actions.

        The department head will judge each accident on its own merit and

        severity and follow the following guidelines:

        First offense = verbal warning or written reprimand as appropri-

        ate, defensive driver training and/or other applicable training.

 

        Additional offense(s) =  written reprimand and other disciplinary

        action as appropriate, including possible suspension or termina-

        tion based on the circumstance, frequency, and severity of acci-

        dent(s) and the number of points assigned by the Department of

        Motor Vehicles.

 

    D.  Reports will include a review of liability claims by Department

        Heads.  Including a summary the the departments review practices,

        strengths/weaknesses, corrective actions, trends, training needs,

        and staff performance.

 

    E.  Review of each division of each department as to function, poten-

        tial liabilities, corrective actions taken to better serve the

        citizens of Santa Cruz County.

 

    F.  Recommendations as to future actions which may be advisable to

        protect the County, i.e. initiate/modify special training pro-

        grams, staffing reorganization, policy/procedures to identify and

        reduce exposures.

 

2.   Each Department shall submit the required information to the Risk

     Management Division of the Personnel Department.  Departmental reports

     will be due on or before December 31, of each year in a format pre-

     scribed by Risk Management (PER5002).  Reports will be transmitted to

     the Board of Supervisors in January of each year.
