SANTA CRUZ COUNTY

              AMENDMENT TO MEMORANDUM OF UNDERSTANDING

                 DISTRICT ATTORNEYS' BARGAINING UNIT

 

 

This is an amendment to the April 13, 1991 - April 12, 1996 Memorandum of

Understanding between the County of Santa Cruz and the District Attorneys'

Association.

 

Both parties agree that this amendment is the result of meeting and confer-

ring in good faith under the terms of State law and County regulations.

 

The following provisions shall amend and replace the terms of the 1991-1996

District Attorneys' MOU.  All other Articles of the 1991-1996 MOU, not

amended herein, shall remain in full force and effect.

 

                             Article 1

                    MEMORANDUM OF UNDERSTANDING

 

The new term of the MOU shall be from -------------  November 29, 1997

through ---------------- December 1, 2000.  All other provisions of Article

1 shall remain in full force and effect.

 

                             Article 4

             FAIR EMPLOYMENT PRACTICES-AFFIRMATIVE ACTION

 

The County and the Association agree that no person employed or applying

for employment shall be discriminated against because of race, color, reli-

gion, age, disability, medical condition (cancer related), national origin,

ancestry, marital status, sex, sexual orientation, age (over 40), veterans

status, or any other non-merit factor except where sex or physical capabil-

ity is determined to be a bona fide occupational qualification after con-

sideration of reasonable accommodation factors in relation to the essential

job duties of the position.  The parties also agree to support Affirmative

Action efforts which are intended to achieve equal employment opportunity

as provided for in Federal and State requirements.

 

                             Article 8

                                PAY

 

B.  Salaries: The salary range and hourly rates for classes in this repre-

sentation unit shall be the same as for the equivalent County Counsel

classes. (See Appendix B for equivalent classes.)

 

                             Article 9

              SALARY, COMPENSATION AND LEAVE PROVISIONS

 

The same salary, compensation and leave provisions of Section 160 of the

Personnel Regulations applicable to employees in budgeted positions in the

equivalent County Counsel classes shall apply to employees in the budgeted

positions in this representation unit.

                             Article 10

                         INSURANCE BENEFITS

 

10.1 INSURANCE

 

All provisions regarding employee insurance (e.g., health, dental, long

term disability, and life) applicable to employees in budget positions in

equivalent County Counsel classes shall apply to employees in budgeted

positions in this representation unit.

 

                             Article 13

                             RETIREMENT

 

13.2 RETIRED EMPLOYEES-MEDICAL

 

Employees in budgeted positions in this representation Unit who retire

during the term of this Memorandum of Understanding shall receive medical

coverage on the same basis as employees in the equivalent County Counsel

attorney classes.

 

                             Article 14

                               LAYOFF

 

All provisions regarding layoff applicable to employees in equivalent posi-

tions in County Counsel classes shall apply to employees in this represen-

tation unit.  The layoff provisions applicable to the unrepresented employ-

ees, including County Counsel attorneys, are contained in Article 33 of the

1995-97 Memorandum of Understanding for the Middle Management Representa-

tion Unit.  The same layoff provisions will apply to the District Attor-

neys' Representation Unit, except as otherwise expressly provided in this

Article.

 

Employees in limited-term positions in the District Attorneys' Representa-

tion Unit shall be subject to the same procedures as employees in regular

budgeted positions for purpose of all provisions regarding layoff.  To the

extent this article conflicts with the limited-term provisions of Article

33 of the Middle Management Memorandum of Understanding, this article shall

be controlling.

 

If there is any change in the layoff provisions applicable to the County

Counsel attorneys during the pendency of the MOU, the District Attorneys'

Representation Unit shall be entitled to reopen this article to renegotiate

the layoff provisions.
