 Appeal of the Zoning Administrator’s Approval of a proposal to install 7 new microcell wireless communication facilities, each to be co-located on existing utility poles along inland side of Hwy. 1 (6 sites in Caltrans Hwy. 1 right-of-way, 1 site in County's Swanton Rd. right-of-way).  Proposal includes a 192 square foot, 13'-6" tall equipment shelter (Telecommunications Hub) on an agricultural parcel (APN 058-022-11) Requires a Level 5 Commercial Development Permit, a Level 5 Coastal Development Permit, and three Telecommunications Act Exceptions to requirements contained in the County Wireless Communications Facilities Ordinance.  Appealed 12/16/11 by Andrew and Wan-Jean Hsu.  Six of the proposed utility pole microcell sites are located in the Caltrans right-of-way along an approximately 13 mile stretch of Hwy. 1, beginning 3.8 miles northwest of Western Drive and ending .4 miles northwest of the entrance to Big Creek Lumber. The 7th site is located in County right-of-way along Swanton Rd. on a utility pole  approx. 1.1 miles north of the southernmost Swanton Road intersection with Hwy.1. The equipment shelter is proposed to be located immediately northwest of the southernmost intersection of Highway 1 and Swanton Road.

12. Public Hearing to consider updating regulations in the Santa Cruz County Code, and amend related General Plan(GP) and Local Coastal Program (LCP) policies.
 A proposal to update regulations in the Santa Cruz County Code, and amend related General Plan (GP) and Local Coastal Program (LCP) policies, as follows:  Part 1:  Amend Chapter 13.10 to provide new regulations for nonconforming uses and structures, and amend related GP/LCP policies.  Part 2:  Amend regulations in Chapter 13.10 regarding commercial uses and parking standards.  Part 3:  Delete the amendment defining the word “structure” in Chapter 12.10 as it relates to soils report requirements, and amend Geologic Hazard Regulations (Chapter 16.10) regarding when the County is authorized to require geologic review.  Part 4:  Revise the Level 4 permit approval process in Chapter 18.10.  Part 5:  “Clean-up” various provisions in Chapters 13.10 and 13.11 of the Santa Cruz County Code.  Chapters 13.10, 13.11, 16.10 and 18.10 are Coastal Implementing Ordinances.

  APPEAL INFORMATION
Denial or approval of any permit by the Planning Commission is appealable to the Board of Supervisors. The appeal must be filed with the required appeal fee within 14 calendar days of action by the Planning Commission. To file an appeal you must write a letter to the Board of Supervisors and include the appeal fee. For more information on appeals, please see the "Planning Appeals" brochure located in the Planning Department lobby, or contact the project planner.

APPEALS OF COASTAL PROJECTS
(*) This project requires a Coastal Zone Permit which is not appealable to the California Coastal Commission. It may be appealed to the Board of Supervisors; the appeal must be filed within 14 calendar days of action by the Planning Commission.

(**) This project requires a Coastal Development Permit. Denial or approval of the Coastal Development Permit is appealable to the Board of Supervisors; the appeal must be filed within 14 calendar days of action by the Planning Commission. After all local appeal periods have ended (grounds for appeal are listed in the County Code Section 13.20.110), approval of a Coastal Development permit is appealable to the California Coastal Commission. The appeal must be filed with the Coastal Commission within 10 business days of receipt by the Coastal Commission of notice of final local action.
