 Appeal of Zoning Administrator’s approval of Application 171372 for a Commercial Development Permit, a proposal to construct a new roof mounted Wireless Communication Facility at an existing commercial building (Wilson’s Tire) consisting of two 2-foot high panel antennas camouflaged as stove pipes and construction of a 4-foot high roof mount enclosure (250 square feet in size) to screen associated roof mounted equipment. Project also includes an 84 square foot lease area for ground mounted equipment located on the north side of the building. Property located on the northwest side of the intersection of Soquel Drive and Porter Street (4665 Soquel Drive).

10.Public hearing to review and provide recommendation to Board of Supervisors regarding: proposed amendments to County Code chapters 13.10 and 13.20 to create a Seascape Beach Estates (SBE) Combining Zone District; Zoning Plan Amendment to add 152 parcels to the SBE district; minor variation of condition of approval for PUD/Use Permit 4119-U governing 14 properties in the proposed district; and CEQA Notice of Exemption. The new proposed zone district would assign height, floor area ratio, lot coverage, and setback development standards to the neighborhood, with the purpose of protecting the public viewshed and maintaining neighborhood consistency. Amendments to chapters 13.10 and 13.20 are coastal implementing and will require Coastal Commission certification after County adoption.

 The proposed SBE Combining Zone District area is bordered on the north by Hidden Beach Park, on the east by Via Palo Alto, on the south by Via Verde, and on the west by the public beach.  This project requires a Zoning Plan Amendment to add the “-SBE” Combining Zone District to the zoning for 152 parcels:  APNs 054-181-01-19, 21-38, 054-182-01-13, 054-191-01-30, 32, 35, 39, 41, 48, 53, 59, 61-63, 65, 67, 68, 71, 75, 76, 78-81, 054-192-01-03, 054-222-01-11, 054-223-01-19, 054-231-12, and 054-631-01-18. This project also requires a minor variation to conditions of approval for Planned Unit Development/Use Permit 4119-U for 14 parcels: APNs 054-181-25-38.

  APPEAL INFORMATION
Denial or approval of any permit by the Planning Commission is appealable to the Board of Supervisors. The appeal must be filed with the required appeal fee within 14 calendar days of action by the Planning Commission. To file an appeal you must write a letter to the Board of Supervisors and include the appeal fee. For more information on appeals, please see the "Planning Appeals" brochure located in the Planning Department lobby, or contact the project planner.

APPEALS OF COASTAL PROJECTS
(*) This project requires a Coastal Zone Permit which is not appealable to the California Coastal Commission. It may be appealed to the Board of Supervisors; the appeal must be filed within 14 calendar days of action by the Planning Commission.

(**) This project requires a Coastal Development Permit. Denial or approval of the Coastal Development Permit is appealable to the Board of Supervisors; the appeal must be filed within 14 calendar days of action by the Planning Commission. After all local appeal periods have ended (grounds for appeal are listed in the County Code Section 13.20.110), approval of a Coastal Development permit is appealable to the California Coastal Commission. The appeal must be filed with the Coastal Commission within 10 business days of receipt by the Coastal Commission of notice of final local action.
